Separation Barrier in Palestine | ||
Israel decided on April 14, 2002 to set up a network of walls and other obstacles called the Security Wall (Fence) or Separation Barrier, in the West Bank of the Jordan River. Given the human, social and economic consequences of this wall for the Palestinian people, in December 2003, the UN General Assembly asked the International Court of Justice to give its advisory opinion about the consequences of the Security Wall in the occupied Palestinian territories. According to Article 65 of the Statute of the Court the UN Secretary General announced on December 10, 2003 to the International Court of Justice the decision of the tenth extraordinary UN General Assembly, (A/ RES/ES-10/14 (2003)), demanding the immediate advisory opinion of the court. The question asked from the court was: “on the basis of the report of the Secretary General and given the rules and regulations of international law, particularly the 1949 Geneva Convention (4), and the resolutions of the UN Security Council and General Assembly in this regard, what are the legal consequences and implications of the construction of the wall that Israel, the occupying power, is constructing in the occupied territories, including inside and around the Eastern Jerusalem?” | ||
